TERMS & CONDITIONS

ALL  TOURS

    With your signature on the booking form you accept these terms and conditions as binding for the contract.  Please read them carefully: TOUR OPERATOR is:          
    ANDES  ADVENTURE TOURS, IV Centenario 1207, Las Condes, Santiago, CHILE.

    AGENTS AND REPRESENTATIVES:

    AAT  Agents and Representatives represent us, but are not a party of this contract, nor are they in any event responsible or liable for any failure to provide any service as may be described in our literature pertaining to the contract.

    RESERVATIONS AND DEPOSITS:

    For the tour, a booking deposit is required at the time of booking.  This deposit secures space on the tour.  The balance is due 60 days before the tour starts.

    Price List does not include motorcycle insurance, for this reason AAT offers an insurance with a deductable. We recomend it, if not at your own risk.                              

    A safety deposit has to be paid at the rental center at time of delivery of the motorcycle at the beginning of the rental period.  This safety deposit will be refunded upon the return of the undamaged motorcycle.

    The rental period is not interupted due to riding inability of the renter or for any other reason .  During the tour  AAT is not obliged to replace a damaged motorcycle.

    PRICE OF TOUR INCLUDES:

    The items included in the tour price are listed as follows.  The tour price includes hotel accomodation in double or twin rooms or cabins.  Single tour members will be paired with another member at our discretion unless  the desired roommate is indicated on the booking form.   Meals included are:  American breakfast, picnic or box lunch, full dinner.  Meals include coffee, tea or soft drinks.  Wine and other alcoholic beverages are not included.  For the motorcycle, fuel and lubricants are included.  On tours where some nights are spent in camp, tents and necessary camping supplies are provided (two persons per tent, each must provide his own sleeping bag).

    PRICE OF TOUR DOES NOT INCLUDE:

    All items not mentioned as included and all items of a personal nature.

    CANCELLATIONS AND REFUNDS:

    Cancellations received more than 60 days prior to departure will be subject to a US$200 per person cancellation fee.  Cancellations received less than 60 days prior to departure will be subject to the following forfeit of tour cost; 59-42 days, 20% of tour cost; 41-14 days, 40% of tour cost; within 14 days 100% of tour cost.  Trip cancellation insurance is strongly recommended.

    Up to three  weeks prior to the tour start,  AAT is authorized to cancel the tour if a sufficient number of customers for the particular tour is not reached.  In this case the customer will be notified forthwith and his payment refunded in full, which constitutes the full settlement.  When the tour cannot be started or has to be interrupted or ended for reasons outside of the control of  AAT, its contractors or the customers, as well as in case of force majeure such as riots, floods, earthquakes, strike, etc., the contract becomes invalid.  If the customer does not comply with traffic laws or the requirements for group travel the contract may be cancelled by  AAT and the rental motorcycle secured.

    PASSPORTS, VISA, DRIVING AND HEALTH REGULATIONS:

    The customer must assure compliance with the above requirements and all consequences resulting from noncompliance are his responsibility.

    RESPONSIBILITY:

    AAT is responsible for providing the services listed in the tour description according to local standards and guarantees the accurate description of services offered in its literature.

    AAT Is responsible for conscientious travel preparations.  AAT is not responsible or liable for any accidents.  AAT reserves the right, without prior notice to withdraw any part or all of a tour, to make such changes as may be necessary and the extra cost, if applicable, resulting therefrom, shall be paid by the customer.

    Furthermore, it is agreed and understood that the owners, operators and agents of this tour, including  AAT, are not the guardians of any customer's safety and they, individually or collectively, cannot be held liable in any way for any occurrence in connection with the operation or the client's participation in connection with the tour which might result in injury, death or other damage to the client, his property, or his family, heirs or assigns.

    AAT is not responsible or liable for a delay occuring from the manufacturers' or dealers' failure to deliver the motorcycle on time.  The liability of  AAT as the tour operator is limited to a total of two times the tour price irrespective of the title.  AAT is not responsible for any delays, changes in schedule or other conditions.

    Some tour countries operate on a seasonal basis and where seasonal variances and/or weather conditions cause changes in the tour routing and accommodations, the itinerary will be adjusted accordingly and alternate hotels, restaurants and roads will be used.

    TOUR RATES, RENTAL RATES, AIR FARES AND MOTORCYCLE COSTS are calculated on the basis of exchange rates in effect at the time of printing and on tariffs and air fares currently valid and are subject to change depending on international currency fluctuations and/or inflation or airfare increases and to confirmation or adjustment by AAT upon receipt of final payment 60 days prior to tour start.

    VERBAL CHANGES of contract are invalid unless confirmed in writing by  AAT.

    AAT RESERVES THE RIGHT to correct printing errors or calculation mistakes at any time.  Should portions of these terms and conditions become invalid the rest of the terms and conditions remain unaffected.
